Welcome to VapeAway. By using our app (the "App") you agree to comply with and be bound by the following terms of service (the "Terms"). Please read these Terms carefully. If you do not agree, do not use VapeAway.

1. Acceptance of Terms

By accessing or using the VapeAway app, you agree to these Terms and our Privacy Policy. These Terms constitute a binding agreement between you and VapeAway.

2. Description of VapeAway

VapeAway is a mobile app that helps individuals reduce or stop vaping. It provides:

- A personal dashboard tracking vape-free days, money saved, and milestones reached.
- An AI-powered chat designed as supportive, motivational conversation during cravings. The chat is not medical advice.
- A personal inspiration board for photos, quotes, and reminders stored locally on the device.
- An educational body-recovery timeline describing typical physical changes after stopping vaping.
- A rewards and streaks system to reinforce progress.

VapeAway does not provide medical, psychological, or health advice. All information is for informational and motivational purposes only.

3. Eligibility

VapeAway is intended for users aged 13 and older. You are responsible for ensuring compliance with any applicable local laws regarding the use of such tools and regarding nicotine or vaping products.

4. No Professional Advice

VapeAway is not a substitute for professional medical, psychological, or health advice. Always seek the advice of qualified professionals regarding your health or any medical condition. VapeAway disclaims any liability for decisions you make based on the information provided in the App.

5. User Responsibilities

You agree to use VapeAway only for lawful purposes and in compliance with these Terms. You understand that the information provided by the App is for personal use only and is not intended for medical diagnosis or treatment. You are solely responsible for your use of the App and any decisions you make based on its content.

6. Subscription Terms (VapeAway Premium)

VapeAway is free to download and use. We offer an optional auto-renewable subscription, "VapeAway Premium", that removes daily limits on certain features and removes ads.

- Billing: subscription payment is charged to your Apple ID (on iOS) or Google Play account (on Android) at confirmation of purchase.
- Auto-renewal: your subscription renews automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal charge: the account is charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
- Managing and cancelling: you can manage or cancel your subscription at any time from your Apple ID account settings (iOS) or Google Play subscriptions (Android). Uninstalling the app does not cancel the subscription.
- Free trial: any unused portion of a free trial period, if offered, is forfeited when you purchase the subscription.
- Refunds: refund requests are handled by Apple or Google according to their respective policies.

7. Intellectual Property

All content, features, and functionality in the VapeAway app, including text, graphics, logos, and software, are the exclusive property of VapeAway or its licensors and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use of any content is prohibited.

8. Limitations of Liability

To the fullest extent permitted by law, VapeAway and its affiliates, officers, employees, and licensors shall not be liable for any damages arising out of or related to your use of or inability to use the VapeAway app. This includes, but is not limited to, direct, indirect, incidental, consequential, and punitive damages.

9. Disclaimer of Warranties

The VapeAway app is provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied. VapeAway does not guarantee that the App will be error-free or uninterrupted.

10. Third-Party Links and Services

The VapeAway app may contain links to third-party websites or resources and relies on third-party services for analytics, in-app advertising (for free users), and purchase processing (Apple App Store and Google Play). VapeAway is not responsible for the content, products, or services of these third parties. Use of their services is at your own risk and subject to their own terms.

11. Modifications to the App and Terms

VapeAway reserves the right to modify or discontinue the app, or any part of it, at any time without notice. We may also update these Terms from time to time. Continued use of the app after changes to the Terms constitutes your acceptance of the revised Terms.

12. Termination

We may terminate or suspend your access to the app at our sole discretion, without notice, if we believe you have violated these Terms or for any other reason.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts with appropriate jurisdiction.
